ct. no. 24 WPA 6295 of 2018 Chandeshwar Prasad Vs.

Union of India & Ors.

Mr. Bipul Kumar Mandal, .... For the UOI.

None appears on behalf of the petitioner.

It is submitted by the learned advocate for the respondent that he appeared on the earlier occasion but the order was not correctly made to that effect. Accordingly order dated 14.6.2024 is hereby corrected to the effect that the learned advocate Mr. Bipul Kumar Mandal represented on behalf of the Union of India before this Court on 14.6.2024.

Learned advocate for the respondent submits that the instant matter became infructuous as the petitioner has already retired from his service.

It appears that the petitioner has challenged the order of inter-battalion periodical transfer from Chattaranjan to Dhanbad issued by the respondent on March 28, 2018. One ad interim relief was granted in favour of the petitioner. Now, this matter appears before this Court after six years.

Considering the submission of the learned advocate for the respondent that the present petitioner has already

been retired from his service, it appears to me that the instant matter become infructuous. However, the petitioner is not present. Accordingly, the instant matter is hereby dismissed for default.

Any interim order passed by this Court on the earlier occasion is hereby also vacated.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. ( Subhendu Samanta, J.)
