It is alleged that the private respondents have unlawfully and illegally filled up a pond which is impermissible in law. On behalf of the private respondents, it is submitted that there is no merit in the allegation made on behalf of the petitioner and the petitioner as well as the private respondents are co-sharers in respect of the above premises.

On behalf of the Howrah Zilla Parishad, it is submitted that they have no objection if the above representation is considered in accordance with law. S.D.

In view of the above, WPA 8478 of 2024 stands disposed of by directing respondent no. 4 to consider and dispose of the representation dated 11th March, 2024

within a period of eight weeks from the date of communication of this order and in accordance with law after giving a right of hearing to all the parties. It is made clear that there has been no adjudication on the merits of the case and the respondent no. 4 is to act in accordance with law without being influenced by any observation and after hearing all the parties.
