The order proposed to be passed in the present revisional application under Article 227 of the Constitution of India would not cause any prejudice to the opposite party, as such, service of notice of the present revisional application upon the said opposite party is dispensed with. The petitioner is the plaintiff of Ejectment Suit No. 25 of 2015 which is pending before the 1st Court of learned Civil Judge (Junior Division), Alipore, District- 24- Parganas (South). The petitioner is complaining inordinate delay in disposal of the said suit and is prying for a direction over the learned Trial Judge for expeditious disposal of it.

It appears from the record that the suit is at the stage of recording evidence of the witnesses from the side of the defendants.

The suit is pending since 2015 and has reached a very matured stage, therefore, there cannot be any plausible reason to defer the disposal of the said suit.

The learned Trial Judge is requested to dispose of the said Ejectment suit No. 25 of 2015 in accordance with law as expeditiously as possible, preferably within a period of six available effective working months of the said Court from the date of communication of this order and in doing so shall not grant any unnecessary adjournment to either of the parties. The petitioner shall communicate this order to the learned advocate representing opposite party in the Court below within a week from date.

C.O. 873 of 2021 is disposed of with the above terms without any order as to costs.
