(via video conference) Mr. Shibendra Nath Chattopadhyay Mr. Priyam Misra ...for the petitioner This is an application seeking an expeditious disposal of a proceeding under Section 125 of the Code. Learned counsel appearing on behalf of the petitioner submits as follows. The petitioner had filed an application under Section 125 of the Code claiming maintenance allowance from the husband/opposite party no.1. in the year 2010. She is getting a paltry sum as interim maintenance allowance. Despite a previous direction passed by this Court on 05.04.2019 to conclude the proceeding within a year, till date, the proceeding could not be concluded.

On several occasions, adjournments were granted. Long dates are being fixed. The matter has remained pending for no fault of the present petitioner.

I have heard the submissions of the learned counsel appearing on behalf of the petitioner and have perused the revision petition.

No prejudice will be caused to anyone if a direction is passed to expedite the proceeding.

It appears that there is an inordinate delay in disposing of the application, considering the fact that the application for maintenance allowance was filed in 2010.

Even an earlier direction by this Court to expedite the proceeding could not inspire the learned trial Court to conclude the proceeding within a reasonable time. In view of the above and in the interest of justice, I request the learned trial Court to conclude the proceeding under Section 125 of the Code at the earliest without granting any unnecessary adjournment to any of the parties, positively within six months from the next date of hearing.

With these observations, the revisional application is disposed of.
