The order proposed to be passed in the present revisional application under Article 227 of the Constitution of India would not cause any prejudice to the opposite party, as such, service of notice of the present revisional application upon the said opposite party is dispensed with. The petitioner is the plaintiff of Ejectment Suit No. 24 of 2015 which is pending before the 1st Court of learned Civil Judge (Junior Division), Alipore, District- 24- Parganas (South). The petitioner is complaining inordinate delay in disposal of an application under Order XVIII Rule 17 of the Code of Civil Procedure filed by him on February 05, 2021 and is praying a direction upon the learned Trial Judge for expeditious disposal of the said application. The suit is pending since and application filed by the petitioner under Order XVIII Rule 17 of the Code of Civil Procedure is

required to be disposed of expeditiously in order to dispose of the of the suit itself.

The learned Trial Judge, therefore, is requested to dispose of the said application as expeditiously as possible without granting any unnecessary adjournment to either of the parities.

It is made clear that this Court has not gone into the merit of the said application; it is for the learned Trial Judge to decide the same in accordance with law.

C.O. 875 of 2021 is disposed of with the above terms without any order as to costs.
