Mr. Kaushik Gupta ...for the petitioners Mr Gupta appears and submits on behalf of the petitioners. The proceedings relate to a case No.C/606/01 under sections 138/141 of the Negotiable Instruments Act pending before the learned ACMM, Calcutta.

As the revisional application is of the year 2003 and the records of this case do not reflect the present status of the proceedings in the court below, I am of the view that further retaining the matter in the High Court in its revisional jurisdiction is unwarranted. The last order sheet reflects that the learned ACMM, Calcutta posted the matter for examination under section 251 CrPC the case on May 8, 2003.

Having regard to the delay which has contributed because of the pendency of the revisional application, I am of the view that the petitioner would be at liberty to take up the points canvassed in the revisional application in course of trial and at the appropriate stage of the proceedings.

This court has not considered the merits of the revisional application and accordingly learned Magistrate will be at liberty to independently formulate his opinion so far as the points are concerned.

With the aforesaid observations, CRR No.928 of 2003 is disposed of.

Interim order, if any, is hereby vacated.
