This revisional application has been filed praying for expeditious disposal of application under Section 151 of the Code of Civil Procedure filed by the petitioner in connection with Title Suit No.31 of 2021 pending before the learned Civil Judge, Junior Division, Kalna, Purba Bardhaman. It is the contention of the petitioner that the said application should be heard expeditiously as the reliefs prayed for, are directly for implementation of the protective orders of ad interim injunction passed in favour of the petitioner. Without going into the merits of the case and without going into the issue raised by the petitioner, this revisional application is disposed of with a direction to the learned Court below to allow the petitioner to file a put up application for pre-poning the date of hearing of the application.

Petitioner is directed to serve a copy of this revisional application along with a server copy of this order in the Head Quarters of the WBSEDCL Bidyut Bhavan and also upon the opposite party within a week from date.

The opposite party shall be at liberty to file their written objection to the said application. As the application under Section 151 of the Code of Civil Procedure is already part of the revisional application, no further service would be required, the opposite party shall file the written objection within ten days from date.

The learned Court below upon being satisfied that the same has been served upon the opposite party, shall fix the hearing of the said application once the opposite party shall file their written objection within the time prescribed by this Court.

This Court has not gone into the merits of the claims of the petitioner and the learned Court below shall proceed independently and in accordance with law and shall decide the issues on the basis of the pleadings and objections of the respective parties.

The revisional application is disposed of.

There will be, however, no order as to costs. Urgent Photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
