Jayati Das Sarkar versus Sri Soumen Das This revisional application has been preferred challenging the order dated 06.11.2020 passed by learned Judicial Magistrate, 2nd Court, Barrackpore in connection with M. Case No. 446 of 2019 in an application under Section 125 of the Code of Criminal Procedure.

The grievance of the petitioner is that although dates have been fixed, but there has been no progress in the proceedings under Section 125 of the Code of Criminal Procedure which the petitioner preferred for dire requirements to maintain herself. In view of the prayer advanced before this Court and the time period which has in the meantime passed, I direct that in case the proceedings under Section 125 of the Code of Criminal Procedure and the relief prayed therein is still under consideration before the learned Judicial Magistrate, 2nd Court, Barrackpore, in that case, the learned Magistrate will fix dates once in a fortnight so that trial of the case can be taken to its logical conclusion preferably by 31.08.2023.

With the aforesaid observations, the revisional application being CRR 964 of 2021 is disposed of. All pending connected applications, if any, are consequently disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
