Krishna Roy (Das) -Vs.- Sri Aloke Roy The present revisional application has been preferred against the order dated 25.02.2021 passed by the Learned Judicial Magistrate, 2nd Court, Barrackpore, North 24 Parganas in connection with M. Case No.564 of 2019 under Section 125 of the Code of Criminal Procedure. The grievance of the petitioner is that in spite of the application under Section 125 of the Code Criminal Procedure being filed in the year 2019, the hearing of the interim maintenance petition was being adjourned and on 25.02.2021 the learned Magistrate was again pleased to adjourn the matter and fixed for hearing.

I have perused the contents of the revisional application and the anxiety expressed by the petitioner, more than one and half years have already been passed since the said order was passed. In case, the interim maintenance application till date has not been disposed of, the learned Magistrate is directed to dispose of the same within a period of one month from the date of communication of this order. Learned Magistrate would take steps so that the main application under Section 125 of the Code of Criminal Procedure and the trial proceedings involved therein are concluded by 31st January, 2024. With the aforesaid observations, C.R.R.965 of 2021 is disposed of. Pending applications, if any, are consequently disposed of. Department is directed to communicate this order to the learned Judicial Magistrate, 2nd Court, Barrackpore.
