Heard the learned advocate representing the writ petitioner. The learned State advocate is also present.

The writ petitioner, an Upper Division Clerk was transferred to A.B.N. Seal College Cooch Behar from the Government General Degree College, Chapra at Nadia. The transfer was by an order dated 17.02.2026. The consequential release order is dated 09.03.2026. The petitioner claimed to have joined the transferred place pursuant to the release order, on 12.03.2026.

The learned advocate for the writ petitioner submits that from the earlier representation filed by the writ petitioner; it is obvious that the writ petitioner's only son, aged about 15 years, suffers from a psychiatric disorder, which is certified to
be having a consequence of 50% "intellectual disability". He submits that there is a policy in the State Government that in the event of such a disability, the authorities are required to consider a posting making it convenient for the Government employee to balance his work as well as the care required to be given to the dependant. He submits that relying on such policy decision, the petitioner would approach the authority by way of a representation.

The policy being referred to, is not in record. 6.
We, therefore, do not wish to make any comment on the merits of such claim to be made by the writ petitioner by way of representation, and leave it for the authorities to consider in accordance with law.

It is needless to say that in case such a policy decision highlighted in a representation to be filed, the authorities would be obliged to consider the same.

The Writ Petition is disposed of.
