The present revisional application has been filed for transferring the proceeding being Misc. Case No.264 (7) of 2017 pending before the learned Judicial Magistrate, 3rd Court, Berhampore, Murshidabad to the Court of the learned C.J.M., Alipore, 24 Parganas, South. The main grounds which have been assigned by the petitioner is that she filed the case at Berhampore, but, subsequently she was transferred to Swastha Bhawan and is employed at S.S.K.M. Hospital, as such, she would face difficulty in case she has to attend the Court at Berhampore, Murshidabad. Professional compulsions cannot be a ground for transferring a proceeding from one Court to another Court. The petitioner is in a transferable job and, as such, she may be subsequently also transferred during further pendency of the proceedings. For such reasons, the Court according to the convenience of parties cannot change or transfer the case always. The reasons so assigned by the petitioner is not acceptable to this Court.

Accordingly, C.R.R.969 of 2021 is dismissed.

Pending applications, if any, are consequently disposed of. All parties are directed to act on the server copy of this order downloaded from the official website of this Hon'ble Court.
