Learned advocate appearing for the petitioner submits that the petitioner is in custody for 820 days. The petitioner is the owner of immovable property in India. The petitioner is an Indian citizen.

Learned advocate appearing for the State submits that the trial is in progress. The next date is May 21, 2022 for the purpose of recording the evidence of the prosecution. The petitioner is being proceeded against inter alia under the provisions of the Foreigners Act. The issue is as to whether the petitioner is an Indian citizen or not is yet to be decided. Consequently, we are not inclined to grant bail to the petitioner.

Prayer for bail of the petitioner is rejected. CRM (DB) 1107 of 2022 is dismissed.
