Allowed C.R.M.(A) 1044 of 2024 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Khayrasole Police Station Case No. 117 of 2023 dated 03.12.2023 under Section 399/402 of the Indian Penal Code pending before the learned Judicial Magistrate, Dubrajpur, Birbhum.

And In Re : Sourav Das ...... petitioner Mr. Kunal Ganguly ...for the petitioner Ms. Amita Gaur Ms. Suchismita Dutta ...for the State Materials in the case diary do not suggest the requirement of placing the petitioner in custody for interrogation, at this stage.

In such circumstances, we grant anticipatory bail to the petitioner.

Accordingly, we direct that in the event of arrest, the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/-, with two sureties of like amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973. The petitioner will report before the Investigating Officer once a fortnight till the conclusion of the investigation.
