1. Learned advocate representing State respondents submits that though authority of Hatgacha Haridas Vidyapith, South Parganas (hereinafter referred to as 'said school') issued 'no objection' on transfer application of the petitioner on 9th February, 2024 but till date transfer application has not been forwarded to the District Inspector of Schools (SE) South Parganas being respondent no. 5 for taking further steps.

However, letter of Assistant Headmaster cum Teacher-in-Charge and Secretary of said school dated 2nd September, 2025 addressed

to the respondent no. 5 is placed before this Court and same is taken on record.

2. From the letter dated 2nd September, 2025 it appears that said school authority is willing to forward the transfer application of the petitioner to the respondent no. 5 if direction comes from higher authority.

3. Having considered the submissions made on behalf of the parties and taking note of the letter dated 2nd September, 2025 of Assistant Headmaster of School, President of the Managing Committee of the said school being respondent no. 8 is directed to forward transfer application of the petitioner to the respondent no. 5 by fortnight from the date of communication of the order. On receipt of transfer application respondent no. 5 shall process the same and forward it to the West Bengal Central School Service Commission if petitioner is found to be eligible to be transferred in accordance with Transfer Rules, by fortnight thereafter.

4. On receipt of transfer application the Chairman, West Bengal Central School Service Commission being respondent no. 3 is directed to decide the same in accordance with law by 6 (six) weeks thereafter and decision to be

communicated to the petitioner by fortnight thereafter.

5. It is made clear that suspension of portal shall not be a ground to reject transfer application of the petitioner.

6. Writ petition stands disposed of.

7. Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
