Monirul Islam v. Nasida Bibi

25.01.2023 S/L No.38 KS C.R.R.972 of 2021 Monirul Islam -Vs.- Nasida Bibi The present revisional application was preferred challenging the order dated 17.12.2020 passed by the Learned Judicial Magistrate, Jangipur, Murshidabad in M. R. Case No.425 of 2019 under Section 125 of the Code of Criminal Procedure. The order dated 17.12.2020 reflects that the learned Magistrate on an appreciation of prima facie materials was pleased to award Rs.1,500/- per month to the wife and Rs.1,500/- to the minor child aggregating to a sum of Rs.3,000/- per month. The said quantum amount was by way of interim maintenance during pendency of the main revisional application. Learned Magistrate has also taken into consideration that the husband/opposite party is an able bodied person and is a hotel manager in profession.

Having regard to the reasons so assigned, I am of the opinion that no interference is called for.

Accordingly, C.R.R.972 of 2021 is dismissed.

Pending applications, if any, are consequently dismissed. All parties are directed to act on the server copy of this order downloaded from the official website of this Hon'ble Court.
