No. 29 CHC Rejected C.R.M.(A) 1390 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Patrasayer Police Station Case No. 29 of 2023 dated 29.01.2023 under Sections 341/325/326/307/379/34 of the Indian Penal Code, 1860.

And In the matter of : Srikanta Saha @ Pinku Saha @ Piku Saha & ors. ...... petitioners Mr. Kallol Mondal, Mr. Souvik Das ....for the petitioners Ms. Anasuya Sinha, Mr. Pinak Kr. Mitra ....for the State An incident of assault took place where the petitioners were involved.

Both the injured victim as also eye-witness to the incident claimed that sharp cutting weapons were used in order to assault the injured.

Injuries sustained by the injured are by sharp cutting weapon as appears from the injury report.

In such circumstances, considering the gravity of the offence and involvement of the petitioners in the incident, we are unable to grant anticipatory bail to the petitioners. CRM (A) 1390 of 2023 is rejected.
