Parties are represented by their learned advocate, names of whom are shown at the beginning of this order sheet. The Court is approached under Section 482 of the Code of Criminal Procedure soliciting a direction to ensure expeditious disposal of a pending NDPS case of Learned Additional Sessions Judge Cum Judge Special Court, Hooghly in N.D.P.S. Case No.27 of 2019 under Section 20(b)(ii)(c) of the NDPS Act. Having considered the submissions of learned advocate for the petitioner transpiring that the petitioner is in custody for the alleged recovery of contraband, above the commercial quantity requiring expeditious disposal and the submission raised by the learned State advocate revealing the progress of the case, the Court is of the view that the instant revisional application may be disposed of, so as to subserve the purpose of justice, as proposed to be obtained, giving a direction mentioned as thereunder.

Learned Court below is directed to make effective utilisation of the date for consideration of the charge, and if for any reasons

whatsoever, the same could not be done the charge may be framed within one month thereafter, providing sufficient opportunity of hearing to either of the parties to this case, aiming at ensuring expeditious disposal of this case within a reasonable period of time and, if necessary, upon resorting to steps available under Section 309 Cr.P.C.

With these observations and directions, the revisional application is disposed.
