Kausik CRM (NDPS) 629 of 2026 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Bidhannagar South Police Station Case No. 89/2024 dated 04.06.2024 under sections 22(C)/25/29 of the NDPS Act, 1985.

Learned advocate appearing for the petitioner submits that earlier there was a direction passed in CRM (NDPS) 639 of 2025 wherein the Co-ordinate Bench was pleased to direct that the trial should be completed within 8 months from the next date of hearing. The said 8 months have passed, as such the petitioner prays for bail.

Records also reflect that another accused approached this Court on 11.12.2025 whose bail was rejected. The time frame which is expressed in the orders while rejecting the bail are directory in nature and obviously the same is subjected to the subsequent changes which takes place in course of the proceedings. One of the accused person is absconding. As such

processes have been issued but till date after framing of charge, no witness has been examined.

Having considered the quantum of seizure which is much above the sealing limit (105 gms. MDMA) of commercial quantity, I am not inclined to release the petitioner on bail at this stage.

Accordingly, the prayer for bail of the petitioner is rejected.

However, the learned Trial Court will after exhausting the process of law, if it is unable to complete the 12 witnesses cited by the prosecution within a period of 6 months thereafter the learned Trial Court will release the petitioner on bail on such terms and conditions as he deems fit and proper for ensuring further appearance in course of the trial. With the aforesaid observations CRM (NDPS) 629 of 2026 is disposed of.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
