The West Bengal State Electricity Distribution Company Limited and others Mr. Anil Kumar Chattopadhyay, Mr. Dinesh Pani .... for the petitioner Affidavit-of-service filed in court today be kept on record.
When the matter is called on for hearing, none appears for the West Bengal State Electricity Distribution Company Limited (WBSEDCL), although the petitioner is represented through counsel. Learned counsel for the petitioner submits that despite the objection of the petitioner, the WBSEDCL gave an electricity connection to the private respondent over the land of the petitioner. It is contended that in such context, the petitioner gave several representations to the WBSEDCL for removal of the said electricity line from his property, lastly on February 22, 2022. However, the WBSEDCL is turning deaf ears to such representations.
Accordingly, the limited prayer made in the writ petition is that the WBSEDCL be directed to consider the representation of the petitioner.
In view of the innocuous nature of the prayer, further service of notice on the WBSEDCL is not required.
Accordingly, WPA No. 7446 of 2022 is disposed of by directing the respondent no.2 and 4, that is, the Divisional Engineer and Station Manager of the WBSEDCL concerned, to consider and dispose of the representation of the petitioner dated February 22, 2022, annexed as Annexure-P5 at page-17 of the present writ petition, upon giving an opportunity of representation/hearing to the petitioner as expeditiously as possible, preferably within three weeks from the date of communication of this order to the WBSEDCL.
Parties shall take steps on the basis of the server copy of this order without insisting upon prior production of a certified copy thereof for the purpose of compliance.
There will be no order as to costs.
Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
