None appears for the petitioners.

Learned advocate for the State submits Memorandum of Evidence alongwith the copy of the Case Diary. The ordersheet enclosed alongwith the revisional application reflects that copies under Section 207 of the Code of Criminal Procedure were already supplied to all the petitioners and the case was transferred to the learned Judicial Magistrate, 3rd Court, Durgapur for disposal.

Having regard to the stage at which the petitioners approached this Court, I am of the view that the points so canvassed in the revisional application can only be agitated in course of trial. Accordingly, petitioners will be at liberty to agitate the points canvassed in the revisional application at the

appropriate stage. As such, no interference in called for at this stage.

Accordingly, C.R.R.1108 of 2012 is disposed of. Pending application, if any, is consequently disposed of. Interim order, if any, is hereby vacated.

All parties shall act in terms of copy of this order downloaded from the official website of this Court.
