Adv., Ms. Munmun Tewary ....For the State Mr. Goutam Das Mr. Gazi Faruque Hossain Mr. Rakib Hossain Khan ...For the respondent no. 11 The petitioner has challenged an order of demolition dated October 3, 2024, passed by the SubDivisional Officer, Sadar, Hooghly, under Section 23(5) of the West Bengal Panchayat Act, 1973. By the said order, the Sub-Divisional Officer directed the demolition of a garage constructed without obtaining permission from the competent Panchayat authority.

Learned counsel appearing on behalf of the petitioner submits that the garage in question was not constructed by the petitioner but by Respondent No. 12. It is an admitted position that Respondent No. 12 has not

challenged the aforesaid order dated October 3, 2024 by filing any writ petition.

A perusal of the impugned order further reveals that the petitioner had, in fact, admitted to the construction of the unauthorized garage and sought time for its demolition.

In view of such admission, this Court is of the opinion that the petitioner is precluded from challenging the order of the Sub-Divisional Officer.

Accordingly, W.P.A. 7829 of 2025 stands dismissed. (Kausik Chanda, J.)
