AD 12 May 6, 2026 Ct. 28 SG CRM(A) 1064 of 2026 Allowed An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Islampur P.S. Case No.356 of 2025 dated 12.04.2025 under Sections 108/3(5) of the BNS.

And In the matter of: Ajimuddin @ Azimuddin and another ... petitioners Mr. N.S. Ghosh Mr. S. Alam Ms. Labani Sikder Mr. Souvik Dey ... for the petitioners Mr. Anupam Dasadhikari Mr. Sachit Talukdar ... for the State Report filed by the State is taken on record. Learned counsel for the petitioners submits that the petitioners are the parents of the boy with whom the victim girl had an affair. Both the boy and the girl were juveniles. The boy was granted bail by the Juvenile Justice Court. The petitioners are in no way connected with the alleged offence. The case diary is produced.

It appears from page 53 of the case diary that in the statement of a witness recorded by the police, he claimed that he had seen certain incidents on 10.04.2025 involving the victim and the present petitioners. However, in a subsequent statement of the same witness recorded before the learned Magistrate, he admitted that he did not know

anything about the case. He further stated that for the last six years he had been staying at a place in Bihar. Considering the above and the other materials available in the case diary, I am inclined to grant anticipatory bail to the petitioners.

In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- (rupees ten thousand) each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on the further conditions that the petitioners shall cooperate with the investigation, shall not threaten or intimidate witnesses and the petitioner No.1 shall meet the investigating officer once a fortnight till submission of report in final form.

The application for anticipatory bail is, thus, allowed. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of requisite formalities.
