According to him, from the CCTV footages, it is reflected that three persons were found to be involved in the incident.

Learned advocate for the State submits a report which reflects that Samsherganj P.S. Case No. 38 of 2025 dated 20.01.2025 was registered for investigation under the relevant provisions of law, statement of the accused have been recorded and one of the accused

was arrested. Subsequently, the child in conflict with law was also apprehended.

However, the petitioner complains that he is being threatened at the behest of the private respondents.

Having considered that a criminal case has been registered and the learned Magistrate is already in seisin of the issues, the petitioner, if so advised, would take out an application before the learned Magistrate in respect of the threat which he have been facing.

The learned Magistrate would call for a threat perception report and pass necessary directions upon the police authorities under the Witness Protection Scheme, 2018.

Learned advocate for the private respondents, on that other hand, submits that there was a civil case pending and the present criminal case has been instituted as a counter-blast to the outcome of the civil suit.

Be that as it may, in view of the investigation of Samsherganj P.S. Case No. 38 of 2025 is progressing, I am of the opinion that, at this stage, no further direction(s) and/or order are required to be passed except those under the Witness Protection Scheme, 2018.

With the aforesaid observations, WPA 7855 of 2025 is disposed of.

Pending application(s), if any, is also disposed of.

Report so submitted be kept with the record. A copy of the report be handed over to the learned advocate for the petitioner.
