Jalilur Rahman @ Jalu Babu ... petitioner Mr. Arijit Ganguly, Mr. Sandip Chakraborty ...for the State The present revisional application was preferred challenging the charge-sheet filed in connection with Samsergunj Police Station Case No.56 of 2002, dated 16.07.2002 under Sections 364, 365 and 420 of the Indian Penal Code.

The petitioner approached before this Court at the stage when the learned trial court fixed date for framing of charge. The revisional application was preferred in the year 2012 and the records reflect that on a number of occasions adjournment was sought for and thereafter, lastly, the matter was fixed on 30th November, 2012.

On perusal of the ordersheet it reflects that the revisional application was not admitted before this Court and is pending.

Having regard to the fact that the offences so complained of are heinous offences and no information has been furnished before this Court regarding the present stage of the proceedings before the learned court below, I am of the view that any order passed at this belated stage would prejudice either of the parties, as the circumstances may have changed before the learned trial court and there is every possibility of trial being concluded in the meantime.

In view of the aforesaid, the revisional application being C.R.R.1120 of 2012 is dismissed.
