Mr. Shataroop Purkayastha Ms. Jagriti Bhattacharya ....for the petitioners This is an application for quashing of proceeding in which a charge sheet was submitted under Sections 498A, 326 of the Penal Code and Sections 3 and 4 of the Dowry Prohibition Act. Reference is made to the deposition of the victim/de facto complainant and it is contended that she did not support the prosecution case. It appears that there are serious allegations made against the accused and a charge sheet was submitted under Section 326 of the Penal Code. It is for the trial court to consider the evidence adduced and the other materials on record and then come to conclusions in this regard.

In view of the same, the prayer for quashing is rejected. However, the learned trial court shall consider all the points agitated by the parties, not be swayed by any observation made herein and shall make all endeavours to conclude the proceeding at the earliest.

With these observations, the revisional application is disposed of. Urgent Photostat certified copy of this order be supplied to the parties, if applied for, as early as possible. (Jay Sengupta, J.)
