WPA 8171 of 2026 (Mangala Pramanik vs. State of West Bengal & Ors.) Mr. Banshi Bandan Maiti .... For the Petitioner Ms. Srilekha Bhattacharyya .... For the State None appears for the respondents despite service. Ms. Srilekha Bhattacharyya, learned counsel who is present in Court and usually appears for the State is requested to represent the State in this matter. Her appointment be regularised by the appropriate authority. The petitioner is directed to serve copy of the application along with annexure thereto upon Ms. Bhattacharyya in course of this day.

The husband of the petitioner was appointed as Panchayat Secretary of Maipith Baikunthapur Gram Pannchayat and died in harness on 8th July, 1990. Despite completing all pension related formalities within due time, pension payment order was issued by the concerned authority on 16th November, 1998. The gratuity amount and arrear pension were disbursed on 10th July, 1999. The petitioner seeks interest on the gratuity amount and arrear pension paid to her due to delay in disbursal of the same.

Upon consideration of the submission made on behalf of the parties and material on record, the

Director of Pension, Provident Fund and Group Insurance, Government of West Bengal and the Treasury Officer, Baruipur, being the 3rd and 4th respondents herein, are directed to pay interest to the petitioners at the rate of 8% per annum on the gratuity and arrear pension amount calculated from 9th July, 1990 till the date of actual payment. Such payment shall be made within two months from the date of communication of this order.

The writ petition is accordingly disposed of. There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.
