This revisional application has been filed praying for expeditious disposal of Misc. Case No.732 of 2012 arising out of Title Execution Case No.44 of 2012 in Title Suit No.2049 of 1993, pending before the learned Judge, IXth Bench, City Civil Court at Calcutta.

The records reveal that the misc. case is at the stage of arguments. Records also reveal that the misc. case has been placed for arguments on several occasions, but arguments have not yet been completed.

Considering the age of the suit and the age of the execution proceeding, this Court is of the view that justice would be sub-served if the learned Court below is directed to dispose of the misc. case expeditiously, preferably within a period of two months from the next date fixed. This Court has not gone into the merits of the case and the learned Court below shall dispose of the same on its own merits and proceed independently and in accordance with law without granting any unnecessary adjournments to either of the parties.

Petitioner is directed to serve a copy of this revisional application along with a server copy of this order upon the opposite party within a week from date.

The revisional application is disposed of.

There will be, however, no order as to costs. Urgent Photostat certified copy of this order, if applied for, be given to the parties on priority basis. (Shampa Sarkar, J.)
