For the State This is an application under Article 226 of the Constitution of India wherein the writ petitioner is seeking release on interim parole in line with the minutes of a meeting dated March 27, 2020 of the High Powered Committee.
I have heard Counsel on behalf of both the parties. In my view, the petitioner is required to make an application in the prescribed procedure under Section 62(7) of the West Bengal Correctional Home Act, 1992 (in short 'the Act'). It is to be noted that the petitioner has not yet made any application to the concerned authority under the Act.
Accordingly, this writ petition is disposed of directing the petitioner to make a prescribed application within a period of seven days and upon such application being made, the concerned authorities are directed to
take a decision upon the same within a period of three weeks.
As a consequence, the writ petition and CAN applications are disposed of.
