Santosh Hembram v. State Of West Bengal And ANR
25.06.2026
IN THE HIGH COURT AT CALCUTTA
Item No.66 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc.
Rejected C.R.M. (M) 874 of 2026 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with Raipur Police Station Case No. 32 of 2025 dated 22.03.2025 under Section 70(1) of the Bharatiya Nyaya Sanhita, 2023.
And In Re : Santosh Hembram ... Petitioner.
Mr. Soumik Ganguly ... For the Petitioner.
Mr. Krishnendu Bhattacharya, Mr. Soumya Raha ... For the State.
Affidavit-of-service filed on behalf of the petitioner be kept with the record.
Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 14 months and charge-sheet has already been submitted. Prosecution has relied upon 13 witnesses in order to prove its case. However, the medical reports do not support the case of the prosecution.
Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and draws the attention of the Court to the statement of the victim under Section 183 of the BNSS as also other supporting materials. It has also been pointed out that the case is at the stage of consideration of charges.
Having regard to the statement of the victim which categorically states the complicity of the present petitioner,
at this stage, I am not inclined to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected. The application for bail, being CRM (M) 874 of 2026, is, thus, dismissed.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
