And In the matter of : Injamul Haque @ Mafijul Sk @ Mofijul Sk .... Petitioner Mr. Moyuk Mukherjee Mr. Amanul Islam Mr. Sourav Mukherjee ...for the Petitioner Mr. Brajesh Jha, PP (In-Charge) ...for the State The allegation against the petitioner is that the petitioner and co-accused persons had forcefully entered into the hospital on 30th October, 2023 and allegedly assaulted the duty doctor, guards, other staff and nurses and prevented them from performing their duties and also had broken chairs and doors and other equipments of the Hospital alleging negligence of the doctor.
The learned Counsel for the petitioner submits that the petitioner is in custody since 12th February, 2026 and the
investigation has already been culminated into a charge-sheet and, therefore, his further detention will not yield any fruitful result.
The learned Counsel for the State opposes the prayer for bail contending that he is the kingpin of the alleged offence and that initially he was absconding.
In reply, the learned Counsel for the petitioner submits that he initiated a proceeding for quashment, which is still pending for disposal.
Having heard the learned Counsel for the petitioner and the State and also having gone through the materials available in the case diary and also considering the fact that the investigation has already been culminated into charge sheet and there is hardly any chance of early commencement of trial, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner namely, Injamul Haque @ Mafijul Sk @ Mofijul Sk, shall be released on bail upon furnishing a bond of Rs.10,000/- with two registered sureties of Rs. 5,000/-each, one of whom must be local, subject to the satisfaction of the learned Chief Judicial Magistrate, Krishnagar at Nadia and on condition that the petitioner shall not leave the jurisdiction of the Trial Court without leave of the Trial Court and shall remain present during trial. Accordingly, CRM (M) 888 of 2026 is disposed of. Urgent Photostat certified copy of this order, duly applied for, be given to the parties upon compliance of all requisite formalities.
