Criminal Revisional Jurisdiction 28-03-2024 Subha Item no. 41 Ct no.34 CRR 1247 of 2024 Payel Majumder and anr.

-versus- Mr. Vivekananda Mondal Mr. Satyam Mukherjee Ms. Sayani Ahmed ....for the petitioners.

Learned advocate for the petitioners submits that the complaint case being Complaint Case No. 1479 of 2019 was preferred and is presently pending before the learned Judicial Magistrate, 1st court, Barasat. Last of the order-sheet reflects that on 4th December, 2023, date has been fixed on 3rd July, 2024 for examination of the accused under Section 251 of the Code of Criminal Procedure. The learned trial court would ensure that the examination under Section 251 of the Code of Criminal Procedure is completed on 3rd July, 2024 or in the alternative by 31st July, 2024. In case, the accused is absent, the presence of the learned lawyer would be sufficient to overcome the said stage under Section 251 of the Code of Criminal Procedure.

The learned Magistrate would thereafter fix one date in a month for the purposes of the present case so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. It is further directed that in case there is a resolution of the local Bar, the participating advocate will not stall the proceedings and the trial of the case would continue. All efforts be taken to conclude the trial at the earliest. No unnecessary adjournments be granted to any of the parties and in case further delayed tactics are adopted by the accused the learned Magistrate will not deter from exercising harsher process of law.

With the aforesaid observations, the revisional application being CRR 1247 of 2024 is disposed of.
