This application under Article 227 of the Constitution of India is at the instance of the defendants praying for a direction upon the learned Civil Judge (Senior Division), Kakdwip, South 24Parganas to dispose of the Title Suit No.31 of 2021, expeditiously.

In view of the order sought and proposed to be passed, there is no necessity to direct issuance of any notice upon the opposite parties. However, the learned advocate-on-record of the petitioners shall be obliged to forward a copy of this application along with this order, upon the opposite parties or upon the learned advocate representing the opposite parties before the learned Trial Judge.

From the order-sheets appended to this application, this Court finds that July 31, 2025 has been fixed for hearing of the petition under Order 8 Rule 9 of the Code of Civil Procedure dated 2nd July, 2024.

In the light of the submission made by the learned counsel for the petitioners, C.O. No.1208 of 2025 stands disposed of by requesting the learned Civil Judge (Senior Division), Kakdwip, South 24Parganas, to take up the hearing of the application dated July 2, 2024 under Order 8 Rule 9 of the Code of Civil Procedure on the next date fixed for hearing on 31st July, 2025, if the same is otherwise ready for hearing, and make an endeavour to dispose of the same as expeditiously as possible without granting any unnecessary adjournment to either of the parties. After disposal of the application, the learned Trial Judge shall make an endeavour to dispose of the Title Suit No. 31 of 2021, without granting any unnecessary adjournments to either of the parties as expeditiously as possible.
