Pursuant to the order dated 16.05.2024 as passed by a coordinate Bench in this appeal, a report dated 26.07.2024 is submitted to the effect that the appellant, Haripada Das died on 13.01.2019.

Pursuant to the said order, some of the respondents are produced before this Court. The personal appearance of the respondents who are present before this Court are hereby dispensed with.

On perusal of the entire file of papers, it reveals that the instant appeal has been preferred by the said Haripada Das, since deceased challenging the judgment and order of acquittal of the respondents in CR Case No. 48 of 1998 by the learned Judicial Magistrate, Jhargram, Midnapore. 4.

In view of the fact that the appellant, Haripada Das is no more in the earth, the instant appeal being CRA 172 of 2000 is abated and is thus disposed of.

Department is directed to send down the LCR along with a copy of today's order forthwith (Partha Sarathi Sen, J.)
