1. Mr. Susanta Pal, learned counsel appearing on behalf of the contemnor no. 1, has submitted that the State of West Bengal has preferred the Special Leave Petition on 17th September, 2024 and the matter is likely to be listed shortly.

2. Mr. Supriyo Chattopadhyay, learned A.G.P appearing on behalf of the contemnor no. 2, submits that the Education Department, Government of West Bengal, has forwarded all the necessary documents to the Finance Department. Hence, the Education Department has complied with the order.

3. On 26th July, 2024 we have recorded the submission of the learned counsel for the alleged contemnor no. 1 that in absence of a report being

received by the Education Department, the direction contained in paragraph 52 of the order dated 3rd January, 2024 could not be complied with.

4. It appears from the aforesaid submission that the Finance Department has principally accepted the said order but the only impediment was that no final decision could be taken in absence of any report from the Education Department. However, today it is submitted that State of West Bengal, Finance Department, has preferred a Special Leave Petition.

5. In view of the aforesaid, the matter shall be listed in the combined monthly list of December, 2024.

6. Liberty to mention, in the event the Special Leave Petition is disposed of in the mean time.

7. The new incumbent in the post of Principal Secretary, Finance Department, Government of West Bengal, Mr. Prabhat Kumar Mishra and Principal Secretary, Education Department, Government of West Bengal, Mr. Binod Kumar are taken on record in respect of contemnor nos. 1 and 2 respectively.

8. All parties shall act on the server copies of this order duly downloaded from the official website of this Court.
