Affidavit-of-service filed in Court be kept with the records. The unserved writ petition addressed to the General Manager is opened from the envelope and handed over to the learned advocate representing HPCL.

The petitioner no. 1 prays for consideration of the application filed before HPCL seeking transfer of the business and the license in favour of the petitioner no. 2.

Learned advocate representing HPCL submits, upon instruction that, the said representation may be considered in accordance with the prevailing guidelines.

Learned advocate for the petitioners submits that after filing of the writ petition, HPCL is taking coercive steps.

The aforesaid allegation is denied by the learned advocate representing HPCL.

At this stage, without entering into the merits of the allegation made by the petitioners regarding taking coercive steps, the instant writ petition is disposed of by directing the respondent no. 3 to consider and dispose of the prayer of the petitioner no. 1 dated 23rd June, 2022 appearing at page 94 of the writ petition strictly in accordance with the prevailing guidelines of the Company after giving reasonable opportunity of hearing to the petitioners and by passing a reasoned order within a fortnight from the date of communication of this order.

The reasoned order shall be communicated to the petitioners immediately thereafter.

The respondents are restrained from taking coercive step, if any, against the petitioners prior to passing a final order in response to the representation dated 23rd June, 2022.

It is made clear that this Court has not decided upon any other issues in the writ petition and it will be open for the petitioners to take steps to challenge or agitate the same before the competent forum including the High Court in accordance with law, if so advised.

10. The writ petition stands disposed of.

11. Urgent photostat certified copy of this order be supplied to the parties, if applied for, as early as possible.
