The State is represented by the learned counsel. The petitioner alleges illegal and unauthorized construction at premises no. B/136/H/22, Narkeldanga Main Road under Ward No. 30 and Borough III of the Kolkata Municipal Corporation. The petitioner also alleges that the complaint lodged before the Kolkata Municipal Corporation has not been considered till date.

None represents the private respondents.

Learned advocate representing the Municipality has received instruction that the premises in question was inspected and on detection of

unauthorized construction, steps have been take to initiate proceedings under the provisions of Section 400 of the Kolkata Municipal Act, 1980. The proceeding has since been concluded and steps have also been taken for demolition of the unauthorized construction at the second floor of the subject structure. A considerable portion of the subject structure has been demolished.

From the report of the Corporation it is not very clear as to whether the entire unauthorized construction has been demolished or not.

In view of the above, the Executive Engineer of the concerned Borough is directed to take steps for demolition of the entire unauthorized structure at the earliest, if not demolished in the meantime. The writ petition stands disposed of.
