No one appears on behalf of the respondents, despite service.

Learned counsel appearing on behalf of the petitioner submits as follows. The private respondent had come up with an illegal construction on government land near the petitioner's property. This is blocking the ingress and egress to the petitioner's property. Accordingly, on 25.01.2023 the petitioner made a representation before the concerned authorities including the Sub-Divisional Officer, Haldia praying for taking action in terms of the provisions of the West Bengal Public Land (Eviction of Unauthorised Occupants) Act, 1962. However, the representation has not been responded to as yet. It appears that the petitioner's representation dated 25.01.2023 is pending consideration before the concerned authorities.

In view of the above, let the Sub-Divisional Officer, Haldia consider the petitioner's representation dated 25.01.2023 in accordance with law and upon hearing the petitioner and other interested parties as expeditiously as

possible, preferably within a period of eight weeks from the date of communication of this order.

It is made clear that the merits of the case have not been gone into.

With these observations, the writ petition is disposed of. As affidavits were not called for, allegations contained in the writ petition are deemed not to have been admitted. Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for. (Jay Sengupta, J.)
