By the present writ petition, the petitioner seeks for direction upon respondent no. 3, the Director of Madrasah Education to approve the appointment of the teachers as teaching staff of Khosalpur Darul Islam Senior Madrasah at Khosalpur, Post Brindabanpur, P.S. Domkal, Dist. Murshidabad. 3.

The petitioner contends that the Khosalpur Darul Islam Senior Madrasah at Khosalpur, Post Brindabanpur, P.S. Domkal, Dist. Murshidabad was an organizer institution and was subsequently granted approval from the Government of West Bengal as an unaided Madrasah. The petitioner was engaged by the Managing Committee as a teaching staff to render education to the local children. On 11th September, 2013, the Madrasah was given recognition.

Subsequent thereto the Managing Committee sent a list of teaching staff for approval by the appropriate authority. However, subsequently, it was detected that inadvertently the name of the petitioner was not included in the list sent for approval of the teaching staff. On 2nd January, 2023, the Secretary of the Khosalpur Darul Islam Senior Madrasah Centre informed the Secretary of the Government of West Bengal Madrasah Education that the name of the petitioner was not mentioned in the earlier list due to mistake. Hence this writ petition.

Mr. Bari, learned advocate appearing for the petitioner submits that respondent no. 3, the Director of Madrasah Education be directed to take appropriate steps with regard to the approval of the teaching staff of the Madrasah within a stipulated period.

Mr. Bhaskar Prasad Vaisya, learned Additional Government Pleader representing the State submits that the letter has been sent by the Secretary of the Khosalpur Darul Islam Senior Madrasah Centre to the Secretary of the Government of West Bengal Madrasah Education which ought to have been sent to respondent no. 3, the Director of Madrasah Education which is the appropriate authority.

Despite service none appears on behalf of respondent no. 8, Abur Rouf Mondal.

In view of such circumstances, respondent no. 6, the Managing Committee of the Khosalpur Darul Islam Senior Madrasah at Khosalpur, Post Brindabanpur, P.S. Domkal, Dist. Murshidabad is directed to send a revised list of the teaching staff of the said Madrasah to respondent no. 3, the Director of Madrasah Education within a period of two weeks from the date of communication of this order. Upon receipt of such revised list of the teaching staff, respondent no.3, Director of Madrasah Education shall consider and dispose of the same in accordance with law as expeditiously as possible upon notice to the petitioner as well as to all interested parties.

Learned advocate for the petitioner is directed to communicate this order to respondent no. 3, the Director of Madrasah and respondent no. 6, the Managing Committee of the Khosalpur Darul Islam Senior Madrasah at Khosalpur, Post Brindabanpur, P.S. Domkal, Dist. Murshidabad, for necessary compliance.

With the above observations, WPA 8584 of 2024 stands disposed of.

10. Since no affidavits have been called for, the allegations made in the writ petition are deemed to be not admitted.

11. Consequently, connected applications, if any, also stand disposed of.

12. Interim orders, if any, stand vacated.

13. There will be no order as to costs.

14. Urgent certified photostat copy of this order, if applied for, shall be given to the parties as expeditiously as possible on compliance of all necessary formalities. (Bivas Pattanayak, J.)
