The petitioner has preferred the present writ petition seeking action against the alleged illegal and unauthorized construction being carried out at Premises No. B/3A/H/10, Gobra Gorosthan Road, P.S. Topsia, Kolkata, at Ward No. 59 under Borough-VII of the Kolkata Municipal Corporation. 3.

Learned Advocate for the Kolkata Municipal Corporation submits that the authorities have duly acted upon the complaint of the petitioner. Pursuant to such action, a demolition order dated 30.08.2023 has been issued in respect of the said premises. Copy of the said demolition order dated 30.08.2023 is taken on record. It appears from the order that the illegal and unauthorized construction was carried out without obtaining any sanctioned building plan.

Learned Advocate further assures this court that necessary action shall be taken in compliance with the aforesaid demolition order in accordance with law, as expeditiously as possible.

In view of the above submissions and in the light of the demolition order already passed by the competent authority, the present writ petition stands disposed of, with the direction upon the Kolkata Municipal Corporation to ensure due implementation of the demolition order dated 30.08.2023, strictly in accordance with law, without any undue delay. 6.

Since no affidavits have been filed by the respondents, the allegations made in the writ petition shall not be deemed to have been admitted.

There shall be no order as to costs.
