Petitioner is aggrieved by the interference at the behest of the private respondent no. 6 which is a Club and according to the petitioner in spite of direction passed by the learned Civil Judge (Junior Division), 2nd Court, Barrackpore yet the private respondent in violation of the injunction order has been creating their dominance because respondent no. 6 are group of persons who have influence to exert their authority over the property.

Learned advocate for the State submits since the civil court is already in seisin of the issue, so far as the right, title and interest in the property is concerned the police authorities are reluctant to interfere with the same. I have considered the submissions of the petitioner and having regard to

the fact that an injunction order is still in existence in respect of peaceful possession of the present petitioners, I direct that if the petitioners take out an appropriate application for rendering police assistance in respect of the injunction order so passed and the learned civil court after hearing the necessary parties is pleased to pass direction for rendering police assistance, in that case, the police authorities would respect, obey and implement the order of the civil court. In the meantime, police authorities would ensure no untoward incident results because of the strained relationship existing between the petitioner and the private respondent no. 6.

With the aforesaid observations WPA 7886 of 2025 is disposed of.
