(DB) No. 1309 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with English Bazar Women Police Station Case No. 152 of 2017 dated 24.07.2017 under Sections 370/376D of the Indian Penal Code read with Sections 6/14 of the POCSO Act.

And In Re : Chandana Mondal ..... petitioner Mr. Saikat Chatterjee Mr. Abdur Rakib Mr. Puranjan Pal ... for the petitioner Mr. Neguive Ahmed, learned APP Ms. Jonaki Saha ... for the State Learned Counsel for the petitioner submits she is in custody for more than three years. It is also submitted there is delay in trial. She prays for bail.

Learned Counsel for the State opposes the prayer for bail.

We have considered the materials on record. Allegations involve gang rape of a victim. Complicity of the petitioner has transpired from the statement of the victim. Bail prayer of the co-accused has been turned down. Keeping in mind the aforesaid facts and gravity of the offence, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.

Trial court is directed to expedite the trial and conclude the same at an early date without granting unnecessary adjournment to either of the parties.
