CRM No. 3101 of 2021 (Via Video Conference) In the matter of an application for bail under Section 439 of the Code of Criminal Procedure, 1973 in connection with Ulberia Police Case No. 43 of 2020 dated 25.01.2020 u/s. 363/365 thereafter adding section 302/201/120B IPC. And In Re : Jairul Sk. @ Jika- petitioner (In jail) Ms. D. Mitra ...for the petitioner Mr. R. Roy Chowdhury Mr. Gupta ... for the State It is submitted by the learned counsel for the petitioner as well as the State counsel that two accused persons, namely, Kazi Nurujamman @ Lalu Kazi and Sk. Moinuddin @ Patal were enlarged on bail by a Co-ordinate Bench of this Hon'ble Court. It is further submitted that the present petitioner stands on the same footing.

However, learned counsel for the State submits that the accused persons enlarged on bail are not attending the trial court which finds reflection from the order dated 18.03.2021 on the date of framing of the charge.

It is true that the petitioner also stands on the same footing. Though the offence alleged is on a graver footing, State counsel has no objection.

Considering the submissions of the learned counsel appearing for the parties, the petitioner, Jairul Sk. @ Jika will be released on bail upon furnishing bond of Rs. 10,000/-(Rupees Ten Thousand only) with two sureties of like amount to the satisfaction of the learned Chief Judicial Magistrate, Uluberia. We direct that all the accused persons including the present petitioner, who are enlarged on bail, would attend the trial court on each and every date fixed by the trial court. In default, the learned Sessions Judge will be at liberty to cancel the bail granted by this Court. CRM 3101 of 2021 stands allowed.
