From the affidavit of service it appears that the petitioner has served copy of this application in the Government Pleader's office on 6th April, 2021. This is the second time when nobody is appearing for the State.

The petitioner's prayer is that he is a nonteaching staff working in the school without post sanctioning memo for which the District Inspector of Schools (S.E.), Dakshin Dinajpur wrote to the Deputy Director of School Education (G.A.) by his letter bearing memo no. 1078 dated 21.06.2018.

Learned advocate for the petitioner submits that till date nothing has been done and in the meantime three years have passed. However, he made one representation to the appropriate officials of the State including the Commissioner of School Education on 15th February, 2021 for considering his problem with regard to retention of approval of his appointment as clerk in his present school etc. or to transfer him to any other place.

The petitioner has only prayed consideration of his representation dated 15th February, 2021 which is

at Annexure P-5 (at page 26) by the Commissioner of School Education.

I direct the Commissioner of School Education, being the respondent no. 2 herein, to consider the representation, if necessary by giving an opportunity of hearing to the petitioner and the school authority or its headmaster, within a period of eight weeks from date and intimate the petitioner about the decision of his consideration within a period of two weeks thereafter. With the above direction this writ application stands disposed of.
