There is substance in the submission of learned counsel for the petitioners that applications, for amendment and injunction respectively, have been kept pending unnecessarily for an inordinate period in the court below.

In view of the innocuous nature of the order proposed to be passed, no notice need be served on the opposite party.

C. O. No. 889 of 2021 is disposed of by requesting the Civil Judge (Junior Division), Second Court at Alipore, District- South 24 Parganas, to take up for hearing and dispose of all pending applications in connection with Ejectment Suit No. 104 of 2012, pending in the said court, as expeditiously as possible, positively

within one month from the date of communication of this order to the court below.

The petitioners shall communicate this order to the court below, as well as to the opposite party and/or the learned advocate appearing for the opposite party in the court below, at the earliest.

The trial court as well as the parties shall act on the written communication of the learned advocate for the petitioners, accompanied by a server copy of this order, without insisting upon prior production of the certified copy thereof. There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
