Ct. No. 28 PRITAM [Rejected] C. R. M. (A) 1163 of 2025 In Re: An application for anticipatory bail under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in connection with Kharagpur (Town) Police Station Case No.52 of 2025 dated 24.01.2025 under Sections 85/115(2)/117(2)/109(1)/89/76/303(2)/351(3)/3(5) of BNS, 2023.

And In Re: Abul Hasan.

...for the petitioner.

Mr. Nonigopal Chakraborty .... for the petitioner.

Mr. S. S. Imam, Ms. Debolina Das .... for the State.

1.

Learned advocate appearing on behalf of the petitioner submits as follows. There is a civil dispute between the families involved in this case. In fact, a civil suit is pending. The petitioner is absolutely innocent. There is delay of 17 days in lodging the FIR. The other co-accused were granted anticipatory bail by the Sessions Judge.

2.

Learned advocate appearing on behalf of the State vehemently opposes the prayer for bail and submits that the medical documents clearly evince the mark injury that was inflicted on the petitioner. It is clearly mentioned that the injury occurred due to physical assault. The present petitioner is the main culprit who has given the fatal blow, as per statement made by the victim before the learned Magistrate.

3.

Considering the incriminating materials available in the case diary and the role ascribed to the present petitioner, I am not inclined to grant anticipatory bail to the petitioner. 4.

Accordingly, the prayer for anticipatory bail is rejected. 5.

CRM(A) 1163 of 2025 is dismissed.
