Heard learned counsels for the parties.
The petitioners are in custody for more than a year and pray for bail.
Learned counsel for the petitioners submits that the 2nd petitioner was not identified in TI parade and was also not present at the place of occurrence at the relevant time. Seizure list showing seizure of Samsung tab and mobile phone is the only incriminating material against him. The LTI of the father of the 2nd petitioner was obtained in a blank paper which was later manipulated as the seizure list. 3 out of 7 witnesses have already been examined. Further detention of the petitioner is not required. The grounds of arrest were not stated to the petitioners at the time of arrest. Learned counsel for the State opposes the prayer.
It appears that the petitioner nos.1 and 3 have been identified in TI parade. Seizure list pertaining to the 2nd petitioner also bears the signature of the petitioner's brother as admitted by the said petitioner. Trial has progressed satisfactorily.
Considering the material on record as well as alleged involvement of the petitioners in the alleged crime, prayer for bail is rejected at this stage.
Learned trial Court is directed to expedite the trial without granting any unnecessary adjournment to either of the parties.
The application for bail is thus disposed of. Case diary be returned.
