(DB) No. 1314 of 2023 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with Gazole Police Station Case No. 66 of 2003 of 2021 dated 11.04.2003 under Sections 363/366/34 of the Indian Penal Code added Sections 372/376 of the Indian Penal Code.

And In Re : Ataur Rahaman ..... petitioner Mr. Kazi M. Rahman ... for the petitioner Mr. Ranabir Roychowdhury Mr. Sanadip Chakraborty ... for the State Learned Counsel for the petitioner submits he is in custody for three years. Inspite of direction by this Court trial has not concluded. He prays for bail.

Learned Counsel for the State opposes the prayer for bail and submits trial has substantially progressed. We have considered the materials on record. Offence involves trafficking of a minor girl. Petitioner had absconded for more than a decade. Trial has considerably progressed and ten witnesses have already been examined.

Under such circumstances and in view of gravity of the offence, we are not inclined to grant bail to the petitioner.

The application for bail is, thus, rejected.

Trial court is directed to expedite the trial and conclude the same at an early date preferably within six months from the
