Affidavit-of-service filed on behalf of the petitioner be kept with the record.

Learned advocate appearing for the petitioner submits that the petitioner has been detained in custody unnecessarily for more than 500 days. Charges have been framed and date has been fixed for evidence.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and produces the case diary.

The earlier order dated 26.11.2025 specifically states that petitioner would approach this Court after the examination of the victim under Section 35 of the POCSO Act is concluded. Having considered the direction passed by this Court on 26.11.2025 and the stage is yet to be completed, I am of the opinion that there are no change of

circumstances. As such, the prayer for bail of the petitioner is rejected.

Petitioner will approach this Court after the evidence of the victim is over as was directed earlier.

Memo of Evidence submitted by the learned advocate appearing for the State be kept with the record. The application for bail, being CRM (M) 877 of 2026, is, thus, dismissed.

All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
