Petitioner seeks bail.

Learned Advocate appearing for the petitioner submits that the petitioner was falsely implicated. The only recovery made from the possession of the petitioner was a bamboo stick. Learned Advocate appearing for the State submits that the petitioner is a part of three-member group who murdered the victim. They pretended that the victim suffered an accident, called an ambulance and took the victim to the hospital. The post-mortem report of the victim, however, states that the death occurred due to the stab injuries. He refers to the statement of ambulance driver. He also submits that there is a forensic examination report stating that the motorcycle of the victim did not meet with any accident. The petitioner was absconding for three years.

Considering the gravity of the offence and the involvement of the petitioner as transpiring from the materials

in the case diary and considering the fact that the petitioner was absconding for a period of three years, we are unable to grant bail to the petitioner.

Accordingly, the prayer for bail of the petitioner is rejected.

C.R.M. (DB) 1120 of 2022 is dismissed.
