Mr. Moyukh Mukherjee Mr. Koustav Lal Mukherjee Mr. Samrat Mondal ....for the petitioner Learned counsel appearing on behalf of the petitioner submits that service was not properly done on the petitioner. The petitioner intends to challenge the main order granting maintenance as well. However, so far as the execution case is concerned, the learned trial court came to a finding that the track report filed on previous day shows that service was good. Accordingly, distress warrant was issued. Later on, the opposite party appeared by filing vakalatnama and prayed for time on the ground which was made out in the petition. The prayer was allowed.
In view of the above, it appears that the learned trial court has fixed the next date for considering the petitioner's application and deciding the matter in accordance with law.
Thus, it will be premature, among other things, to interfere with the proceeding at this stage.
There is no patent irregularity in the impugned order. Therefore, the revisional application is dismissed, however, without any order as to costs.
Urgent photostat certified copy of this order may be supplied to the parties expeditiously, if applied for.
